Ausley & McMullen, P.A. (“the Firm,” “we,” “us,” or “our”) respects the privacy of visitors to www.ausley.com (the “Site”). This Privacy and Cookie Policy explains what information we collect when you visit the Site, how we use it, and the choices available to you. It applies only to the Site and not to any other website you may reach through a link.  In this Policy, “personal information” means information that identifies, relates to, or could reasonably be linked with a particular individual.

1. Summary. We do not require you to provide personal information to browse the Site.  We do not sell personal information or use it for targeted advertising. The Site uses limited cookies to function. Any non-essential cookies — such as the analytics cookies used by Google Analytics — are used only if you consent through our cookie banner.

2. Scope of This Policy. This Policy applies to information collected through the Site. It does not apply to:

•           Client information handled in the course of providing legal services. In representing clients, we process information — including personal information — on behalf of and at the direction of our clients. That handling is governed by our engagement with the client and the rules of professional conduct, not by this Policy, and may be protected by client confidentiality, the attorney-client privilege, and the work-product doctrine. Nothing in this Policy limits those protections.

•           Personnel and job applicants. Information about our personnel and applicants is covered by separate notices and is outside the scope of this Policy.

3. No Legal Advice; No Attorney-Client Relationship. THIS SITE PROVIDES GENERAL INFORMATION ABOUT THE FIRM WHICH SHOULD NOT BE CONSTRUED AS LEGAL ADVICE. YOU SHOULD SEEK PROFESSIONAL COUNSEL BEFORE ACTING UPON ANY INFORMATION IN THIS SITE. IN ADDITION, BY MERELY CONTACTING THE FIRM BY EMAIL, TELEPHONE, OR OTHERWISE, YOU WILL NOT ESTABLISH AN ATTORNEY-CLIENT RELATIONSHIP. THE FIRM CANNOT REPRESENT YOU UNTIL THE FIRM DETERMINES THERE WOULD NOT BE A CONFLICT OF INTEREST, AND THAT IT IS OTHERWISE ABLE TO ACCEPT THE ENGAGEMENT. FOR EXAMPLE, IF YOU EMAIL AN ADDRESS LISTED ON THE SITE, WE RECEIVE THE INFORMATION YOU CHOOSE TO INCLUDE, SUCH AS YOUR NAME, EMAIL ADDRESS, TELEPHONE NUMBER, AND THE CONTENTS OF YOUR MESSAGE. THEREFORE, PLEASE DO NOT SEND ANY INFORMATION OR DOCUMENTS TO THE FIRM (BY EMAIL OR OTHERWISE) UNTIL A FORMAL ATTORNEY-CLIENT RELATIONSHIP HAS BEEN ESTABLISHED THROUGH AN INTERVIEW WITH AN ATTORNEY AND YOU RECEIVE AUTHORIZATION IN THE FORM OF AN ENGAGEMENT LETTER FROM OUR FIRM. ANY INFORMATION OR DOCUMENTS SENT PRIOR TO YOUR RECEIPT OF SUCH AN ENGAGEMENT LETTER CANNOT BE TREATED AS CONFIDENTIAL OR PROTECTED.

4. Information We Collect.

The Site does not include a contact or inquiry form.

Two different types of information may be generated when you visit the Site:

•           Basic technical/request information — such as IP address, browser information, requested pages, timestamps, and, where applicable, referring information — may be processed by the Site's server as part of normal website operation.

•           Google Analytics separately collects analytics and usage information, but only after you consent to analytics cookies through our cookie banner described in Section 5. The categories of information Google Analytics collects are described in Section 6

We use this information to understand Site traffic and performance and to improve the Site. We do not use it to build individual marketing profiles.

5. Cookies and Similar Technologies. A “cookie” is a small text file placed on your device when you visit a website. The Site uses two categories of cookies:

•           Strictly necessary cookies enable core functionality, such as page navigation, session management, security, and storing cookie-consent preferences. To manage consent, the Site uses a consent-management platform, called CookieYes, which displays our cookie banner (“cookie banner”) and places necessary cookies that record and remember your consent choices. The Site cannot function properly without strictly necessary cookies, and they do not require your consent.

•           Non-essential cookies (such as analytics or performance cookies) are used only if you consent — for example, Google Analytics cookies (described in Section 6).

When you first visit the Site, our cookie banner lets you Accept All, Reject All, or Customize your preferences. Non-essential cookies are not activated unless you accept them, and you can change your choice at any time through the cookie banner or your browser settings.

6. Google Analytics. The Site uses Google Analytics to help us understand how visitors use the Site. Google Analytics may collect information about your use of the Site, such as the pages you visit, device and browser information, referring sources, and the dates and times of your visits. Google Analytics is not activated unless you consent to analytics cookies through our cookie banner. Information about your use of the Site may be transmitted to and stored by Google LLC; for how Google handles it, see Google’s Privacy Policy at policies.google.com/privacy. You can also opt out across most websites by installing the Google Analytics Opt-out Browser Add-on at tools.google.com/dlpage/gaoptout.

7. How We Use Information. We use the information described above to:

•           operate, maintain, secure, and improve the Site;

•           respond to email inquiries you send us; and

•           comply with applicable legal and professional obligations.

8. How We Share Information. We do not sell, rent, or trade personal information or use it for targeted advertising. We may share information only:

•           with service providers that support the Site (such as our website host, web developer, and any analytics provider), which may use it only to perform services for us;

•           when required by law, regulation, legal process, or applicable rules of professional conduct; and

•           to protect the rights, property, or safety of the Firm, our clients, or others.

9. Your Cookie and Tracking Choices.  You can accept, reject, or customize non-essential cookies at any time through our cookie banner (as described in Section 5) or your browser settings.  Disabling strictly necessary cookies may affect how the Site functions. You can also opt out of Google Analytics as described in Section 6. The Site does not track visitors across third-party websites or online services over time, and we do not authorize others to collect personal information about your online activities across different websites when you use the Site. Some web browsers offer a “Do Not Track” (DNT) setting or a Global Privacy Control (GPC) signal.  Because the Site does not engage in this kind of cross-site tracking, it does not respond to DNT or GPC signals.

10. Third-Party Links. The Site may contain links to third-party websites. We are not responsible for the privacy practices or content of those websites. We encourage you to review the privacy policies of any website you visit.

11. Children’s Privacy. The Site is intended for a general, adult audience and is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, please contact us and we will take appropriate steps to delete it.

12. Data Retention. We retain information collected through the Site as long as necessary to fulfill the purposes for which it was collected and to meet our legal, regulatory, and professional obligations, including applicable file-retention requirements and limitation periods. When the information is no longer needed, we take reasonable measures to dispose of it securely.

13. Data Security. We maintain reasonable administrative, technical, and physical safeguards designed to protect the information collected through the Site. No method of transmission over the Internet or electronic storage is completely secure, however, and we cannot guarantee absolute security. Because email is not always secure, please do not include sensitive information in an email to us.
